👳‍♂️I'm a foreign employee who has spent a significant amount of time working in Korea. I did not renew my visa, which caused me to become an illegal resident. However, I was caught when others near me reported me. I was sent to a foreigners detention center right away after the police investigation. I have to go to the hospital to get treated for my illness. I'm concerned that I'll have to spend more time at the shelter. How may I obtain authorization for a temporary release from detention?

✅If a foreign national living in Korea breaches the Immigration Control Act, they will have to spend a specific amount of time in jail in a foreign detention center before being forced to leave the nation. The Immigration Control Act is violated by "drug charges" and "illegal alien status," as the narrative above illustrates, therefore being placed in detention is unavoidable.

➡️After thoroughly reviewing the client's arrest charges, Majung devised a plan to get him out of custody. (1) The client just used drugs; no secondary sales were made for profit; and (2) The client's drug use was a single occurrence rather than a habit. The argument put out was rather thorough: (3) Since there was no past criminal history, there was minimal chance of repeat offenses. The client's top priority was that he urgently wanted to be released from custody because he said that staying behind walls at the shelter for an extended period of time would negatively affect his existing business.

➡️The client was granted permission to be released from the shelter for a period of two months following a strong argument by MAJUNG.

Solution#2
The key to getting permission to temporarily release from detention for a period of three months.
✔️A Chinese individual who was detained after becoming an unauthorized resident made the plea for assistance from MAJUNG. We learned that the client had a rare condition known as "patent ductus arteriosus" and was in critical need of treatment. The client stated that he needed time to undergo treatment in Korea, even if it was only for a few months, even though he understood that as an illegal resident, he had to return to his home country.

➡️Majung decided to provide a compelling case for "health reasons" to support the client's request for temporary release from detention. In order to fully explain the client's circumstances, Majung first went to the client's physician in person and obtained "hospital medical records" and the "doctor's opinion." We rationally presented the client's prior medical records and future treatment plans in order to strongly advocate for the legality of the client's stay in Korea.

(3) <Response advice> to get permission for a temporary release from detention.
✔️When someone is placed in a shelter, they are "temporarily" taken out of custody. This is known as a temporary release from a foreigner's detention. It is a temporary suspension of the departure order for a duration of "approximately 3 to 6 months," not a permanent release of protection. During the protection release period, the affected party may: (1) wrap up their life in Korea; or (2) get ready for administrative litigation.

➡️A deposit of up to 20 million won may be deposited when the individual in question applies for temporary release from detention; on behalf of themselves, their family, or a legal representative can apply for temporary release from detention. In addition, you need to be able to provide "clear reasons why protection should be lifted" in order to be granted release.

➡️Even though a temporary release from custody is a method to "temporarily" free someone from custody, getting approval for it is very difficult. Permission to leave the shelter can only be granted if you can articulate your objective reasons for doing so. The following are typical justifications for approving the revocation of foreigners' protection.
1. When medical care in a Korean hospital is necessary for a persistent sickness or other health condition
2. If you have dependents in Korea that you must provide for, including a spouse, parents, or kids.
3. Should you be required to remain in Korea for work-related reasons, such as corporate or business
